These Terms & Conditions (“Terms”) govern your access to and use of cloneclothing.com and shop.cloneclothing.com (the “Website”), operated by ATH Hospitality under the CLONE CLOTHING brand (GSTIN 07ACLFA6795M1ZK). By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, each incorporated by reference. These Terms are framed in line with the Indian Contract Act, 1872; the Consumer Protection Act, 2019; the Consumer Protection (E-Commerce) Rules, 2020; the Information Technology Act, 2000; and the Digital Personal Data Protection Act, 2023.

1. Eligibility

By using the Website you confirm that you are at least 18 years old, of sound mind, and competent to contract under Section 11 of the Indian Contract Act, 1872. We do not knowingly contract with minors without verifiable parental or guardian consent.

2. Accounts

●       You agree to provide accurate, complete, current information and to keep it updated.

●       You are responsible for the confidentiality and security of your credentials and for all activity under your account.

●       Each account is personal and non-transferable. Creating multiple accounts to abuse offers or circumvent policies is prohibited.

●       CLONE CLOTHING may suspend or terminate accounts involved in suspicious, fraudulent, or policy-violating activity, and may require identity verification.

3. Acceptable Use

You agree to use the Website lawfully and not to:

●       Violate any applicable law, or upload content that is unlawful, defamatory, obscene, abusive, or infringing.

●       Infringe any intellectual property or other rights of CLONE CLOTHING or third parties.

●       Attempt unauthorised access, scrape or harvest data, or introduce malware or disrupt the Website.

●       Impersonate any person, post fake reviews, or manipulate ratings or feedback.

CLONE CLOTHING may, at its discretion and without prior notice, restrict or terminate access, remove prohibited content, report violations to authorities, and pursue legal remedies.

4. Products, Listings & Pricing

●       We make reasonable efforts to describe products accurately, but minor variations in colour, texture, or finish may occur due to display settings and manufacturing tolerances; these are not defects.

●       Product images are illustrative. Availability is subject to stock, and listings may be modified or withdrawn at any time.

●       All prices are in Indian Rupees (INR), inclusive of applicable GST unless stated otherwise.

●       Where a price or listing is incorrect due to a technical or typographical error, CLONE CLOTHING may refuse or cancel the affected order even after confirmation, and issue a full refund.

5. Payments & Order Confirmation

Payments are processed through secure, RBI-compliant, PCI-DSS-compliant third-party gateways; we do not store full payment credentials. An order acknowledgement email confirms receipt but does not constitute acceptance. An order is accepted only after internal verification (stock, payment, address, fraud checks) and dispatch with a tracking ID. CLONE CLOTHING may cancel or modify an order for non-compliance, inventory errors, or payment issues, with a full refund where applicable.

6. Cancellation, Returns & Shipping

Order cancellation, returns, exchanges, and refunds are governed by the Return & Refund Policy. Order processing, dispatch, delivery timelines, transit risk, and RTO are governed by the Shipping Policy. Both are incorporated into these Terms by reference.

CLONE CLOTHING operates a defect-only return policy — standard change-of-mind, size, fit, or preference-based returns are not accepted. Defective, damaged, wrong, or undelivered items carry the right to a replacement, exchange, store credit, or refund as set out in the Return & Refund Policy.

7. Intellectual Property

All content on the Website — including the CLONE CLOTHING name, logo, designs, product images, graphics, layout, and code — is the exclusive property of ATH Hospitality or its licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, modify, distribute, or commercially exploit any such content without prior written consent. All rights not expressly granted are reserved.

8. User Content

By submitting reviews, ratings, or other content, you grant CLONE CLOTHING a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt it for marketing and operational purposes, and you confirm it is original, lawful, and non-infringing. CLONE CLOTHING may moderate or remove content that is abusive, misleading, fake, or in violation of these Terms.

9. Indemnity

You agree to indemnify and hold harmless ATH Hospitality and its officers, employees, and partners from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or any policy, your content, your violation of third-party rights, or your unlawful conduct on the Website. This obligation survives termination.

10. Limitation of Liability

To the maximum extent permitted by law, CLONE CLOTHING is not liable for indirect, incidental, punitive, or consequential damages, including loss of data or profit, arising from use of the Website or delays in delivery. CLONE CLOTHING's total aggregate liability for any direct damages shall not exceed the amount actually paid by you for the relevant order. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Force Majeure

CLONE CLOTHING is not liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, war, government action, strikes, pandemics, cyber-attacks, or logistics disruption.

Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, CLONE CLOTHING has appointed a Grievance Officer to receive and resolve complaints. Complaints must be made in writing and include the customer's full name, order ID, registered email, contact number, the nature of the grievance, and any supporting evidence.

The Grievance Officer will acknowledge each complaint within 48 hours of receipt and endeavour to resolve it within 15 working days, in line with the timelines prescribed under the Consumer Protection (E-Commerce) Rules, 2020. Complaints raised only through social media comments or direct messages will not be treated as formal grievances unless also submitted to the email above.

Governing Law & Jurisdiction

This document and any dispute arising from or in connection with it are governed by the laws of the Republic of India. Subject to the grievance mechanism above, the courts at New Delhi, India shall have exclusive jurisdiction.

12. Miscellaneous

●       Severability — if any provision is held unenforceable, the remainder stays in effect.

●       Entire agreement — these Terms with the referenced policies form the complete agreement between you and CLONE CLOTHING.

●       Amendments — we may update these Terms at any time; continued use after changes constitutes acceptance.

By using the Website, placing an order, or transacting, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.
